Draft for review. This text is not an effective agreement. A qualified lawyer must adapt it to [COUNTRY/LAW], confirm the operator and contact details, and review liability, age, consumer-rights and data-protection terms before publication.
In plain words
Shogram lets you check the registration and use status of a Shogram Code. A completed check is not a test of product quality or safety. A Code can be successfully verified once; “Already Used” alone does not prove that a product is counterfeit. Scanning a different kind of barcode does not check it in Shogram. A failed or offline attempt does not give you a Result. Please scan only when you are about to buy the item, protect the Code from copying, and report concerns honestly.
1. About these Terms
These draft Terms explain the proposed rules for using the consumer parts of Shogram. “Shogram” means [COMPANY LEGAL NAME], the operator of the Platform. “Platform” means the Shogram website, applications and verification service that are made available to you.
The Platform’s current public terms are a draft. The Terms will become effective only after the operator is identified, the document is reviewed and approved, an effective date is assigned, and the publication and notice process is in place. The present registration screen asks users to acknowledge Terms and Privacy, but the audited application does not store versioned consumer legal acceptances. Do not treat that screen alone as proof that you accepted a published version.
2. Who may use the consumer service
You may use the service only if you are legally able to do so under [COUNTRY/LAW]. The minimum age and any parent or guardian requirements must be confirmed by qualified counsel before publication: [LAWYER REVIEW: minimum age, capacity and parental consent].
You must sign in to a consumer account before scanning a product or entering a Shogram Code. Creating an account does not by itself mean that your identity has been checked. Any identity-checked status will be explained separately and will apply only to features that are actually enabled.
3. How Verification works
3.1 Use the Shogram scanner
The scanner is for Shogram Codes associated with participating Companies. It does not open, search for or store other barcodes or QR codes. If the scanner says Not a Shogram code, that only means the submitted item was not recognized as a Shogram Code. If an expected Code is missing, that fact alone does not establish whether the product is genuine or counterfeit.
3.2 Confirm before scanning
Before a scan, the Platform asks: “Do you really want to buy this product?” Choose Yes only when you are about to buy the item. No returns you to the dashboard. A cancelled, failed or interrupted attempt does not use up the Code. An offline attempt cannot produce a Result and is not queued as a completed Verification.
3.3 One successful Verification
Each Product Unit is intended to have its own Code. A Code can be successfully verified once. The first valid successful Verification marks it as used. A later check may show Already Used. This can happen for more than one reason, including an earlier check or a copied Code; it is not, by itself, proof of counterfeiting. If you bought the same item earlier, follow the account/device history options shown by the Platform to reopen your own Result where available.
3.4 Results and their limits
The Platform may return Genuine, Already Used, Suspicious, Not Registered, Recalled or Expired. Not a Shogram code and Try again are non-result states. The exact available states depend on the completed service response.
A Result reports the Code’s registration and use status under the Platform’s records and rules at the time of the check. It does not certify, test or guarantee a Product Unit’s quality, safety, effectiveness, composition, suitability or legal compliance. It does not prove that packaging has not been copied or altered. Check the item, label, seals, expiry details and seller as appropriate. If you are concerned, do not rely on the Result alone; use the report or support options that are available to you.
4. Accounts
Scanning and manual Code entry are available only to signed-in consumers. Verification activity is associated with the account and may also use a device identifier for account continuity and security. The service will explain what it stores and how to request access or deletion in the Privacy Policy once an effective policy is published.
Keep your sign-in details private, use a strong password and tell us promptly if you think someone has accessed your account. Do not share an account or use another person’s identity. Account deletion is subject to verified identity, outstanding security needs and retention obligations under [COUNTRY/LAW]; exact deletion and retention rules must be published before this clause is made effective.
5. Reports and information you submit
You may be able to submit a Report about a Product Unit, Code, seller or concern. A Report is information for review, not a confirmed finding. Submit information honestly and include only details needed to explain the concern. Do not submit threats, knowingly false accusations, another person’s private information, or material you have no right to share.
The report form may accept a description, shop name, optional photos and optional approximate location. The precise fields, who can view them, follow-up process and retention period must match the effective Privacy Policy and the live interface. Do not assume that every Report is verified or that a Company receives your identity.
6. Ratings and Promotions
Ratings and consumer Promotions are not currently available in the audited application. The following rules do not activate those features or create an entitlement to use them. If either feature is introduced, it will have separate, effective rules before participation is offered.
If a future Rating feature is offered, eligibility, verified-purchase rules, moderation, company replies and disputes will be stated in the [Ratings and Reviews Policy — route pending]. If a future Promotion is offered, participation will require separate published promotion rules that identify the promoter, eligible locations and users, entry/scoring rules, any Points or Prizes, dates, claims and disputes. Do not treat a scan as an entry or a promise of a Prize unless the specific effective rules say so.
7. Your responsibilities
When using the Platform, you agree to:
- scan only when you are about to buy the Product Unit;
- not copy, publish, sell, transfer, tamper with or misuse a Code or Label;
- provide accurate information and make Reports in good faith;
- not interfere with the service, probe for vulnerabilities outside an authorized disclosure process, automate requests without permission, or try to access another person’s account or data;
- respect intellectual-property, privacy and other rights; and
- follow applicable law and any additional rules that apply to a feature you use.
8. Company information and third-party products
Companies supply information about their identity and Products. A Platform review of Company information is not an inspection or certification of every Product Unit. Product names, trademarks, artwork and claims belong to their respective owners. Shogram does not become the seller or manufacturer merely because a Product appears on the Platform.
9. Availability and changes
The service may be unavailable, delayed or interrupted. If a request fails or you are offline, there is no completed Result. Do not treat an error, timeout or pending request as a verification outcome.
The proposed operator, [COMPANY LEGAL NAME], may update these Terms using a documented notice and version process. The notice period, delivery method and whether renewed acceptance is required for a material change need counsel and product-owner approval: [LAWYER REVIEW: notice, consent and material-change process]. An archived version should remain available at [LEGAL VERSIONS ROUTE — pending].
10. Suspension and ending use
We may need to limit access where required to protect users, investigate misuse, comply with law or maintain security. Before an effective policy is published, the grounds, decision process, notice, urgent restrictions, review and appeal rights must be confirmed and documented. Nothing here creates an unlimited right to suspend an account or remove a user’s statutory rights.
11. Intellectual property
The Platform’s software, design and content are owned by or licensed to [COMPANY LEGAL NAME]. You receive a limited, non-exclusive, revocable right to use consumer features for their intended purpose, subject to effective terms and applicable law. You keep rights in content you submit, while granting only the limited permission needed to receive, review, secure and respond to that submission. The scope, duration and lawful basis for that permission require legal review.
12. Disclaimers and liability
Verification is an information service. It does not guarantee a Product Unit’s authenticity, quality, safety, effectiveness or legal status. Service availability and Company-supplied information may be incomplete or delayed. Reports are unverified until reviewed.
The permitted limits of liability, mandatory consumer rights, remedies and any exclusions must be written for [COUNTRY/LAW] by qualified counsel: [LAWYER REVIEW: liability, warranties, consumer remedies and non-excludable rights]. Nothing in these draft Terms is intended to remove a right that applicable law does not allow the operator to remove.
